MEDIATION & COLLABORATIVE LAW

Many difficult situations need the attention of the Family Court Judge. But statistics confirm that the majority of divorce and family law cases are resolved with minimal disagreement. Many people, both before and after consulting with an attorney, feel they are able to manage their case without an unnecessarily contentious or expensive legal proceeding. I have designed a product of legal service with these things in mind. This service is designed for people who have an "uncontested" or agreed divorce or family law case, or a case where there is minimal disagreement. I serve as an impartial Attorney-Mediator and try to help the parties reach a fair and legal agreement. Instead of spending thousands of dollars in legal fees and months tied up in court, two spouses or parents can sit with me for 2-6 hours and at the end of the day have a Marital Settlement Agreement and/or Parenting Plan that maximizes the best interests of all involved as much as possible under the circumstances.

If your spouse or ex-spouse will agree to sign all necessary legal documents, that reflect the agreements you have made, then you have an "uncontested" divorce or family law case and we can help. The Childress Law Office charges fixed, flat fees, in the following ranges, for uncontested divorce and family law services where we are able to mediate or facilitate an agreement:

$300.00 for a divorce with no children or property issues;

$500.00 for a divorce involving minor children, and no property;

For every division of a business or piece of real estate that must be addressed in the FINAL DECREE OF DIVORCE, we charge an additional $150.00. We provide the legal documents needed for the real estate transaction if, for example, a residence is conveyed from one spouse to another. We also see that the title and mortgage documents are properly recorded in the county's Real Property Records, at no extra charge.

We charge in the range of an additional $100.00 for every other property issue that must be specifically addressed in the FINAL DECREE OF DIVORCE or the FINAL DECREE OF SEPARATION, including issues like - estate planning or tax issues, division of military retired pay, division of debt or personal items, or retirement plans.

For a "Qualified Domestic Relations Order", we charge $500.00. See our Frequently Asked Questions page for more information about "QDROs".

We charge minimum $1500.00 for our uncontested divorce services in cases where the net value of the marital estates, including both separate and community property, is in excess of $750,000.00, or where the divorce agreement is necessarily detailed or complicated. This does not include the usual additional fee for QDROs, if any. There often are estate planning or tax issues involved in the settlement of a marital estate. These issues need and deserve the attention of a professional such as an attorney or CPA.
